Terms of Service for Rogue Stargun

1. Acceptance of Terms

By accessing or using Rogue Stargun (the “Game”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Game.

2. License to Use

DuGames (the “Company”) grants you a non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial purposes, subject to these Terms.

3. User Conduct

You agree not to use the Game in a way that is illegal, harmful, or offensive. Prohibited activities include, but are not limited to, hacking, cheating, harassing other players, or promoting illegal activities.

4. Intellectual Property

All rights, title, and interest in and to the Game, including all associated intellectual property rights, are owned by DuGames. You may not copy, modify, distribute, sell, or lease any part of our Game or included software.

5. Health and Safety Warnings

A very small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain light patterns or flashing lights. Exposure to certain patterns or backgrounds on a VR headset display or when playing video games may trigger epileptic seizures or blackouts in these individuals. These conditions may trigger previously undetected epileptic symptoms or seizures in persons who have no history of prior seizures or epilepsy. The Game may contain flashing lights, images, and other elements that can trigger epileptic seizures or other health issues in susceptible individuals. If you or any of your family members have a history of epilepsy or seizures, consult a doctor before playing. Immediately stop playing and consult a doctor if you experience any symptoms like dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions.

6. Disclaimer of Warranties

The Game is provided “as is” and “as available” without any warranties of any kind, whether express or implied.

7. Limitation of Liability

Neither DuGames nor its sole proprietor will not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Game. To the fullest extent permitted by law, DuGames shall not be liable for any injury, health issues, or related damages that arise from the use of the Game, including but not limited to issues related to epilepsy, injury, bodily harm, or death while playing the game.

8. Termination

DuGames may terminate or suspend your access to the Game immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Your continued use of the Game following the posting of any changes to these Terms constitutes acceptance of those changes.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
